The dark money issue is what Burns sued APS over. The lawsuit was filed in 2015 and the case worked its way through the court system from Superior Court to Appellate Court to the Arizona Supreme Court where it was heard in February 2022, a ruling is still pending. APS/Pinnacle West hid $10.7 million dark money in private non-profit organizations to fund campaign support to get two individuals elected to the Corporation Commission (ACC) in the 2014 election cycle. APS later filed a rate case in 2017 where APS requested a significant rate increase with a re-designed rate structure which resulted in thousands of APS customers paying unnecessary increased prices for electricity.
